Under the California Fair Employment Act, it is unlawful for employers "to refuse to hire or employ the person or to refuse to select the person for a training program leading to employment, or to bar or to discharge the person from employment or from a training program leading to employment, or to discriminate against the person in compensation or in terms, conditions, or privileges of employment" based on sex. The law further defines "sex" to include "pregnancy, childbirth, or medical conditions related to pregnancy or childbirth."

Pregnancy discrimination is another form of sex discrimination in California. According to California statute, women have 4 months of pregnancy leave and are entitled to certain workplace accommodations for the pregnancy.
